Brian King Joseph is suing Will Smith and his company, Treball Studios Management, for wrongfully firing him following an incident in March. Las Vegas on the rapper’s Based on a True Story 2025 Tour.
Joseph has accused Will Smith of “violent behavior” and “deliberately priming and provoking Mr. Joseph into further sexual abuse” during his tour last year.
According to a civil complaint filed on December 31, a The musician claimed in a Los Angeles court that he returned to his hotel room, booked by Smith’s company, to find that someone had come in and left behind a sexual message, wipes, a beer bottle, HIV medication with another person’s name on it, and hospital discharge papers belonging to another person, USA Today reported.
There was a note that read, “Brian, I will be back soon [sic] 5:30, Just Us (Ready Hearts), Stone F.”
Joseph claims that he reported the situation to hotel security as well as the tour management, who accused him of lying and blamed him for the incident. He said he was fired a few days later, although management told him the tour was “moving in a different direction.” He claimed that another violinist was immediately hired in his place, insisting that he was not fired for “sham” reasons.
The lawsuit alleges that Will Smith hired Joseph to perform at a show in San Diego in November 2024 and later invited him to join his 2025 tour and play on his album.
They notified hotel security and representatives of Will Smith and reported the incident to the non-emergency police line. He claimed that just days later, a member of the management team “shamed” him for the incident and told him he was being fired.

The violinist’s lawsuit further alleges that Will Smith was “grooming her for further sexual abuse” after they met in November 2024, as he “began spending additional time alone” in the months before the tour. Joseph claimed the actor commented at one point, “You and I have such a special relationship that I don’t have with anyone else.”
In the lawsuit, Joseph is claiming he suffered PTSD and financial losses as a result of being fired from his job. He is suing for retaliation, wrongful termination and sexual harassment, and damages will be determined by a jury. A representative for Will Smith has not yet commented on the news of the new lawsuit against the actor.
