Delhi High Court issues interim and protect their own IP rights

Mumbai: The Delhi High Court has taken an important step to protect the intellectual property rights of the 1994 Hindi film Endz Apna Apna “.

In an interim order of recent, the court stopped more than 30 parties from the film’s iconic characters, titles, dialogues and unauthorized use of artistic works. This decisive step underlines the importance of safety of creative materials and sends a strong message against violations in the entertainment industry.

Recently, the Delhi High Court issued a John Doo order that provided interim protection for intellectual property rights related to the film ‘Endz Apna Apna’. This order generated by a lawsuit filed by the legal heir of the film’s departed producer, this order, has been identified various identified with the film’s copyright content and unauthorized use of registered trademarks, and attempts to prevent unknown individuals or institutions.

Justice Amit Bansal issued a pre -interim prohibitory verification in a case filed by Vinay Pictures, which was represented by Shanti Vinayakumar Sinha, the legal successor of Vinay Sinha, the late producer of the film. The plaintiff requested protection against alleged violations of copyright and trademark rights including goods, digital materials, domain names and AI-borne materials.

In a statement by a bench of Justice Amit Bansal, “The plaintiff has demonstrated a prima facie case to give an interim prohibitory orders in his favor, and if the pre-part and interim prohibitory verification is not provided, the plaintiff will suffer an irreparable loss.”

The court recorded, “Any objection to the quality of the products of the defendants would be responsible for the plaintiff, as the public would have bought such goods under the misconception that they leave the plaintiff.”

The court further clarified that prohibitory orders cover the mirror and redirect the URL and provided freedom to more violations in the case if necessary.

Through the plaintiff, Advocate Praveen Anand, claimed special rights of all intellectual property related to the film, which includes its characters, dialogues, costumes, styles and popular catchfrages such as’ Ella, ‘Oima,’ and ‘Teja Main Hoon, Mark Idhar Hai’. These components, especially immortal, love, teja and crime master, have become distinguished and have important secondary meanings in the minds of the public.
