“You don’t use another person as a target, as a human target, so it could potentially be negligent,” Erlinda Ocampo Johnson said.

The special prosecutor who resigned moments before Alex Baldwin’s Rust shooting case was dismissed says the actor’s “mischievous behavior” with a gun on set could be viewed as “negligence.” Erlinda Ocampo Johnson unexpectedly left the case Friday when Baldwin’s involuntary manslaughter case was dismissed.

Rust trial’s special prosecutor calls Alex Baldwin’s on-set behavior ‘reckless’

“Based on my evaluation of the evidence that was available to me and what I saw while I was involved in this case, there were multiple clips during filming on set that showed, unfortunately, Mr. Baldwin did some mischief with this gun,” Johnson told NewsNation’s Chris Cuomo.

Citing a previous interview with investigators, Johnson said that “there was a time when he allowed Mr. Baldwin to use himself as a target, to shoot blank bullets at him or at his person, and obviously these are real guns.” He said, “You don’t do that with real guns,” then added, “You don’t use another person as a target, as a human target, so that could potentially be negligent.”

Johnson faced multiple charges after his sudden exit from the case. However, he shrugged them off, saying, “I left because I only learned about this evidence when the public learned about it yesterday afternoon,” the judge said, referring to information the state had hidden from the defense.

“I got involved in this case at the end of April, so I had to gather information on the case. I was not involved in the Hannah Gutierrez case at all,” Johnson added. “And so I had no idea that this individual had taken this ammunition to the sheriff’s department and provided it to officers. I found out about all of this yesterday,” she added.
