Sean “Diddy” Combs is ‘eager’ to testify in his sex trafficking and racketeering case, according to his lawyer, but legal expert Misha Moulton of Misha Moulton Law warns this bold move could backfire.
In an exclusive interview with Page Six, Moulton explained the reason lawyers often keep their clients off the stand is because it exposes them to harsh cross-examination by the prosecution. Earlier, Diddy’s team had revealed that the rapper has his own side of the story, which he wanted to explain in real time. ‘A story of love and heartbreak,’ he says.
Why should sister not testify?
“Testifying at his own trial gives the defendant an opportunity to cross-examine the prosecution,” the Las Vegas-based lawyer told PageSix, referring to the music mogul’s high-profile arrest and serious charges. She describes the process as “mentally grueling”, suggesting that it could lead to inconsistencies in Diddy’s statements and potentially damaging admissions.

The award-winning legal expert added, “If Diddy gets nervous or depressed, taking the stand will do him more harm than good.” He believes that cross-examination will be his “biggest challenge” and strongly advises him to reconsider his decision to testify.
This process “will work tirelessly to find inconsistencies in his statements and to get him to admit to things that could be damaging.”
Diddy needs to prioritize ‘strategic defense’
Considering the serious nature of the charges against him – which include drug crimes, assault, trafficking and molestation, as well as the growing list of alleged victims – experts recommend that Sean “Diddy” Combs prove his innocence. To do this, we should focus on strategic defense. “He needs to prioritize the expertise of his legal team over his desire for personal expression,” he said, adding that he should avoid any statements that could potentially be used against him.
“This level of investigation is very emotionally taxing, and if he struggles to maintain composure under pressure, it could negatively impact the jury’s perception of him,” the lawyer said.
However, it is unclear whether he still wants to take this chance. Previously, Combs’ attorney, Mark Agnifilo, noted in TMZ’s new documentary The Downfall of Diddy: The Indictment that the Bad Boy record producer “wants” to testify in court as he awaits trial behind Brooklyn bars. . Agnifilo said Combs is “very eager to tell his story.” “It’s a human story. It’s a story of love. It’s a story of hurt. It’s a story of heartbreak,” Agnifilo said.

Diddy’s ‘Freak Off’ tape handed over to feds
According to TMZ, the case against Diddy is gaining momentum as new evidence comes to light. Recently, a male sex worker who claims to have had direct contact with Diddy reportedly provided federal prosecutors with a videotape of one of their encounters.
Although it is unclear what exactly is on that tape, it was reportedly presented in exchange for immunity from prosecution, potentially serving as damaging evidence in the ongoing criminal case against the music mogul. The person who provided the tape was said to have signed a proffer agreement.
