Interim bail to Rajpal Yadav in check bounce case, Karkardooma Court issues release warrant.

New Delhi: Karkardooma Court has issued a release warrant for Rajpal Yadav from Tihar Jail, his lawyer said. The lawyer said that he has got interim bail from the High Court in the check bounce case and the actor can be released today.

The Delhi High Court on Monday imposed interim suspension on his sentence till March 18. Passing the order, a bench of Justice Swarn Kanta Sharma directed Yadav to deposit a personal bond of Rs 1 lakh along with a surety of the same amount. The court said that while considering the relief, Rs 1.5 crore has been deposited in the bank account of the defendant. The court ordered suspension of the sentence on the condition that Yadav furnish a personal bond of Rs 1 lakh and a surety of like amount.

He will remain out of custody till March 18, when the court will hear the case again. This came after Avneet Singh Sikka, counsel for private company M/S Murali Projects, confirmed that Yadav had deposited Rs 1.5 crore in the company’s bank accounts in exchange for the bounced check amount. Earlier in the day, Yadav’s lawyer, Advocate. Bhaskar Upadhyay said that he was ready to deposit Rs 1.5 crore without any conditions through Fixed Deposit Receipt (FDR). However, Justice Swarn Kanta Sharma directed that the amount be paid by demand draft (DD).

The court noted that Rs 25 lakh had already been deposited in the name of the defendants by DD, and the actor had earlier deposited another DD of Rs 75 lakh. Earlier, the Delhi High Court had sought response from the complainant on Yadav’s bail plea and listed the matter for Monday on the request of his lawyer. During that hearing, the actor’s lawyer informed the court that a bail plea had been filed and sought time to find a solution, stating that he was unable to be contacted. Accepting the request, a bench of Justice Swarnakanta Sharma directed the complainant to file a reply and adjourned the matter for further consideration.

The Court also made strong comments, noting that Yadav had been jailed for failing to honor earlier commitments made before the Court. Reviewing the case file, the Court noted that several issues had arisen and the earlier order had already been challenged before the Supreme Court, which had not granted any relief.

Earlier, the high court had withdrawn the leniency granted to Yadav in a series of check dishonor cases and directed him to surrender before the jail superintendent concerned, noting that he had repeatedly violated the undertakings given to the court regarding payment of the settlement amount. The sentence given by the trial court was initially suspended to facilitate settlement, but the court found that commitments made were not honored over time, resulting in these proceedings.
