Allegation of use of photographs and identification without permission
Rupali Ganguly has raised the issue of rights to her identity and image in her petition. According to the actress, her photographs and other personally identifiable content are being used without her consent. Their image may be harmed due to fake photographs and edited videos created through AI technology. In the petition, the actress has argued that any person has the right over his picture, voice, name and identity. Using them for commercial or any other wrong purpose without permission is a violation of personality rights. He has asked the court to stop the spread of such content and take action against the inappropriate use of his identity. This case will be heard in the Bombay High Court on November 4. The case will be placed before the bench of Justice Madhav Jamdar. During the hearing, the court will consider the issues raised in this petition.
Samantha Ruth Prabhu has also got relief from the court
The case of misuse of actresses’ identities through AI and deepfakes has already reached the courts. Recently, actress Samantha Ruth Prabhu had also filed a petition in the Bombay High Court. He had alleged that many websites and online platforms are using his photographs, voice and identity to create fake videos, morphed photos and obscene content with AI. Samantha had also demanded protection of her personality rights. In this case, the Bombay High Court had given him interim relief and directed Google, Meta and other online platforms to remove the marked content that misused his identity. This case also highlights that with the increasing use of AI technology, protecting one’s digital identity is becoming a major challenge.

Earlier, actress Preity Zinta had also moved the Bombay High Court against deepfake videos and morphed pictures created by AI. Increasing importance of personality rights in the era of AI
Rupali Ganguly’s case once again raises the question what steps are necessary to protect the identity and personal image of an artist in the digital era. With the help of AI, making changes to photos and videos has become easier than before. But such use of technology, in which a person’s identity is linked to objectionable content without his consent, is a matter of serious concern. Now everyone’s eyes will be on the hearing to be held on November 4.
