The court said that using the song against the backdrop of violence was “not good” and asked the Central Board of Film Certification (CBFC) to decide within a week on the proposed changes to the scene.

A bench of Chief Justice DK Upadhyay and Justice Tejas Karia made the remarks while hearing a Public Interest Litigation (PIL) challenging the use of the song in the film on Thursday.

“Primarily, it does not look good. We have come to a situation where we are following violence,” the bench said.

The case relates to Shurveer’s placement in the film’s climax, where the protagonist engages in a fight with goons. Representing the producer, the lawyer told the court that the song was only used as background music to “decorate” the sequence.

“No character can be compared to a historical figure. It has nothing to do with crime. It is a fight between two factions,” the lawyer said.

The CBFC counsel informed the court that the producer of the film had independently approached the certification body with a proposal to change the scene. The board is expected to decide on the proposed changes.

During the hearing, the petitioner’s counsel expressed concern that the PIL may become futile after the release of the film on OTT platforms. However, the court said, “If they themselves are modifying the song with background music, the whole purpose of filing your petition is achieved.”

The court has listed the matter for next hearing on September 24 and directed the CBFC to take a decision in the meantime.

A PIL has been filed by Prashant Kumar Singh, objecting to the way Shurveer was used in Mirzapur: The Movie. According to the petition, the song’s association with the ideals of Maharana Pratap may create an “unintended association” with the violence and criminal activities depicted in the film.

The petition states that Mirzapur: The film revolves around organized crime, anti-gang and violent criminal activities. It alleged that the film’s protagonists, including Kaleen Bhaiya, were shown running a criminal empire involving arms, drugs and narcotics, extortion, threats, murder and other forms of violence.

The petition further argued that placing a work associated with Maharana Pratap with such scenes may create a misleading connection between the values ​​of warrior courage, honor and sacrifice and the criminality and violence depicted by the gangster characters.
